Terms of Use AI Master

Please read and accept these terms before installing or using the App.

1. By using this application (the App), you engage in chats with Artificial Intelligence (AI).

2. Your use of the App is at your own risk. Ensure compliance with local laws, public order, and personal privacy. You are fully responsible for your use of the App and any content you share or distribute.

3. Vladislav Nasonov grants you a limited, non-exclusive, non-transferable, non-sublicensable, non-assignable, and revocable right to access and use the App.

4. The App is for non-commercial use only. You may not distribute, provide services using the App to third parties, or attempt to profit from it. Refer to the User Content Terms section for commercial use of images generated by the App.

5. Respect our intellectual property rights to source code, UI/UX design, content material, and trademarks.

6. Respect third-party intellectual property rights. DO NOT USE ANY COPYRIGHTED AND/OR TRADEMARKED MATERIALS AS INPUT CONTENT.

7. The App integrates the following third-party materials:
   • OpenAI API: Terms available at https://openai.com/api/policies/service-terms/. Comply with OpenAI Sharing & Publication Policy when sharing User Content*.
   • Microsoft Bing Custom Search API: Terms available at https://www.microsoft.com/en-us/bing/apis/legal.
   • Google Custom Search JSON API: Terms available at https://developers.google.com/terms.

8. User Content refers to any content generated by AI via the App and your input content.

9. All rights not expressly granted herein are reserved.

10. You must be 18 years of age or older to use the App. If you are between 13 and 17 years of age you need to prove that you have your parent or guardian consent to use the App. You cannot use the App if you are under 13 years of age.

11. You are not allowed to upload or generate User Content that shows at least one on the following signs:

• is irreconcilable towards any identity;

• promotes hate or violence;

• implies harassment, threat or bullying;

• is meant for sexual services, contains description of sexual activity or is intended for arousing sexual excitement;

• celebrates the suffering or humiliation of others;

• contains unsolicited bulk content;

• attempts to generate malicious software;

• encourages suicide, cutting, eating disorders and other self-harming activity;

• produces provocative political statements or is intended for campaigning purposes;

• is false or misleading, attempts to defraud individuals or spread disinformation;

• may be considered illegal or inappropriate for other reasons.

12. You agree not to use the App in a way that is unlawful, illegal or unauthorized or that can harm anyone, i.e.:

• is defamatory of any other person, obscene or otherwise offensive;

• infringes any copyright, database right or trademark of any other person or entity;

• advocates, promotes or assists any unlawful act.

13. We are not responsible for the way you use the App. If your behavior is reported to violate these terms, we may take any legal measures pursuant to the applicable laws.

14. We may change or update the App without any prior notice.

15. The App is provided on a free basis. However, certain features may require either one-time in-app purchase or subscription.

16. You may try paid features within a trial period. If you don’t cancel your subscription 24 hours before the end of the trial period, you’ll be charged automatically after the trial expires, and your subscription will be activated on a regular basis.

17. All necessary information about subscription plans can be found on the signup screen that appears before the purchase. We reserve the right to modify, terminate or otherwise amend our offered subscription plans at any time.

18. Subscriptions, including those which start with a free trial period, are automatically renewed for a new billing period, and the charge will be withdrawn within 24 hours before the new billing period begins. If you want to cancel your subscription, the cancellation will apply to the next billing period. Subscriptions are managed by you.

19. Uninstalling the App does not automatically cancel your subscription.

20. You are responsible for all charges incurred from your communication services provider, including data roaming charges. If you are not the bill payer for your mobile phone or tablet device, you must ensure you have obtained permission before incurring any such charges.

21. We urge you to carefully review our Privacy Policy, accessible here.

22. The App is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free access to the App or its functions.

23. We assume no liability or responsibility for any violations caused by your use of the App. You are solely liable for any breaches of third-party intellectual property rights or any other illegal or inappropriate actions. By using the App, you agree to indemnify and hold harmless Vladislav Nasonov, our successors, assigns, licensees, partners, affiliates, officers, directors, and employees from any and all claims, liabilities, complaints, losses, expenses, and damages arising from your use of the App.

24. We are not liable for any damages related to products, services, or information provided by third parties.

25. This Agreement is governed by and interpreted in accordance with the laws of Cyprus. Any disputes shall be resolved amicably within a specified period. If not resolved within this period, the dispute shall be referred to the competent court of Cyprus. You agree to waive the right to pursue or participate in class action proceedings.

User Content Terms

We respect your ownership of your User Content, including both input and output content. You retain all rights to your User Content and assume all associated risks. By providing input content to the App, you represent and warrant that you have the necessary rights, licenses, and permissions. You are permitted to derive benefits from your digital User Content as long as it complies with applicable laws.

Ensure that your User Content belongs to you or that you have the proper rights to use it. User Content must be legal, socially acceptable, and not violate any third-party rights, including copyright and privacy.

Please note that output content may not be unique, and other users may receive similar content from the App. Output content requested by and generated for other users is not considered your own.

You may not use output content to develop artificial intelligence models that compete with OpenAI products and services. However, you can use output content to develop models primarily intended for categorization, classification, or organization of data, provided such models are not distributed commercially.

Referral Program Terms

If you are using the free version of the App, you have the opportunity to participate in our Referral Program to earn additional credits and enhance your experience with the App. By choosing to participate, you agree to abide by the following Referral Program Terms, which form an integral part of our Terms of Use.

Eligibility Requirements:
To participate in the Referral Program, you must meet the following criteria:

• You are a user of the free version of the App (without a subscription).

• You comply with our Terms of Use.

• You and your invitee successfully complete the specified actions outlined below.

Required Actions:
To share your unique invite link with your invitee, follow these steps:

• Open the App, access the menu, and select the "Referral" option.

• On the Referral Screen, copy your invite link and share it with your invitee via email or any other preferred messaging platform.

The Referral Program conditions are considered fulfilled only when your invitee clicks the invite link and installs the App using that link. Your invitee must not be an existing user of the App at the time of receiving the invite link. Additionally, ensure that your invitee uses the same platform (iOS) as you, as invite links currently work only within the same platform.

Upon successful completion of the required actions, you (the referrer) will be rewarded with credits. The number of credits earned per successful referral may vary and will be clearly outlined in the App. You can track your earned credits on the Referral Screen.

Earned Credits and Usage:
Referral credits are valid only within the App and remain available until used. In addition to referral credits, you may receive daily credits, which are provided to all App users on a daily basis. Referral credits can be used in conjunction with daily credits. The usage options for credits may change, and we will notify you of any significant changes within the App.

Credits are non-transferable, have no monetary value, and cannot be exchanged for currency or compensation of any kind.

Violation of the Referral Program Terms will result in the forfeiture of earned referral credits. We reserve the right to modify the terms or terminate the Referral Program at any time. Stay informed about updates by reviewing our Terms of Use regularly.
